Coinbase Pushes for SEC to Release Gensler’s Communications
Coinbase is urging a New York court to compel the SEC to release internal communications involving Chair Gary Gensler.
The crypto exchange’s recent filing aims to obtain documents crucial to their legal battle with the SEC, which has been ongoing since the agency sued Coinbase over unregistered operations.
Coinbase’s motion argues that the SEC has not thoroughly searched for relevant documents and has excluded emails from Gensler, including those from his personal accounts. They claim these documents are vital to challenging the SEC’s claims and supporting Coinbase’s defense.
The case, which began with the SEC’s lawsuit last year, is now in the discovery phase. Coinbase is specifically seeking documents related to the tokens discussed in the SEC’s complaint, deliberations on Coinbase’s public listing in 2021, and Gensler’s statements on cryptocurrency.

Coinbase’s legal chief, Paul Grewal, highlighted the need for these documents to ensure clear understanding and transparency about the SEC’s regulatory stance on digital assets. Gensler was previously subpoenaed for communications from 2017 to the present but has had the request narrowed to his time as SEC chair.
In a recent court session, Judge Katherine Polk Failla questioned the necessity of personal emails but recommended Coinbase file a motion to obtain the documents.
