EU Investigates Microsoft’s Bing Over AI Threats to Elections

Brussels has pinpointed generative artificial intelligence (AI) as a significant concern ahead of the upcoming elections across the 27-country bloc from June 6-9.

In March, the EU reached out to several major digital platforms, including Bing, Google Search, TikTok, and YouTube, to inquire about their efforts to address AI-related risks.

However, Microsoft, which operates Bing, did not provide a complete response regarding specific risks associated with Bing’s generative AI features, such as “Copilot in Bing” and “Image Creator by Designer,” according to the European Commission.

Microsoft has been given until May 27 to submit “internal documents and data.” Failure to comply could result in fines of up to one percent of the company’s total annual income or global turnover, along with potential periodic penalties of up to five percent of its average daily income or daily worldwide turnover.

Since last year, major tech companies must adhere to the European Union’s Digital Services Act (DSA), a significant content-moderation law.

The commission suspects that Bing may have violated the DSA due to risks associated with generative AI, including the dissemination of false information (“hallucinations”) and the spread of deepfakes, as well as potential automated manipulation of services to mislead voters.

Microsoft has expressed its commitment to addressing the commission’s concerns and has emphasized its cooperation in providing information about its approach to digital safety and compliance with the DSA.

Meanwhile, Brussels is closely monitoring Microsoft’s involvement with OpenAI, a prominent AI player, and scrutinizing partnerships such as its 15-million-euro deal with French startup Mistral AI announced in February.
