Elon Musk Files New Lawsuit Against OpenAI Co-Founders

Elon Musk has launched a new lawsuit against OpenAI and its co-founders, Sam Altman and Greg Brockman, reigniting a legal battle that began in March.

This action comes just two months after Musk withdrew his previous lawsuit.

The latest complaint, filed on August 5, accuses Altman and Brockman of breaching their founding agreement by focusing on profit rather than public benefit. Musk claims that the co-founders misled him into helping start OpenAI by exploiting his concerns about AI risks, framing the dispute as a conflict between “altruism and greed.”

The lawsuit argues that Musk was sold on the idea of a non-profit OpenAI, which would attract top scientists and advance AI research to rival Google’s DeepMind.

Instead, Musk alleges that Altman and Brockman shifted OpenAI’s mission towards self-enrichment, marked by a profitable partnership with Microsoft. Although Microsoft had a non-voting board seat at OpenAI, it gave up its observer role in July amid regulatory scrutiny.

Additionally, Musk’s suit includes accusations of racketeering and claims that OpenAI failed to uphold its promise to remain open-source. Musk stated that he aims to strip the defendants of their “ill-gotten gains” through this legal action.

Musk co-founded OpenAI in 2015 and played a key role in its early development. However, he left the organization in 2018. He has since voiced concerns about AI risks and founded x.AI, a for-profit company developing an open-source AI model called Grok.
